It's Elder Law Month: Do You Have a Plan? - Colorado Law Blog

May 1 is law day, we all know that, but did you that May is Elder Law Month? And the issue for elders is not so much to do with age as with planning. For yourself, and for those you love who have reached their senior years, consider the three D's: disability, destruction, and death.

Begin planning now for all three. Begin by tackling two basic components:

  • Prepare a written Advance Directive, often called a Living Will, and Durable Health Care Power of Attorney or Health Care Proxy.

  • Appoint someone to be your trusted agent to speak for you when you cannot speak for yourself regarding health care decisions.

Advance Directives or Living Wills are legal documents that state your wishes about medical decisions. The documents specify your health care desires to family members and medical professionals when you are unable to communicate them due to a serious illness or injury. Advance Directives may consist of one or more documents. Laws about these critical documents vary from state to state. In some states, there are statutory forms that individuals can print, fill out and sign before witnesses. In other states, both statutory forms and customized Advance Directive documents are allowed. In all states, individuals may add more specific and personalized clauses to their Advance Directives. In Colorado, the Colorado Bar Association provides pertinent information at: http://www.cobar.org/Advance-Medical-Directives.

These health care planning documents can be very specific in the instructions that you leave. In a Living Will, sometimes referred to as a Health Care Declaration, you may state your preferences for health care if you have a terminal illness or are in a permanent vegetative state. This document can list your wishes for pain management at the end of life, can instruct doctors and other health care staff on the type of treatments you do or do not want, and can provide for spiritual, emotional and comfort items that you would like to be present at the end of life.

It is important for you to appoint a trusted agent to speak for you when you are unable to speak for yourself with respect to medical decisions. The legal documents can be more general if you wish to have your agent make decisions in keeping with your known wishes. You can change your agent and the instructions that you give as long as you retain the mental capacity to understand the change you are making. Once a trusted agent is appointed, it is vital that you discuss your desires with your agent, your loved ones and your doctor. The discussions will serve to further clarify your specific wishes and priorities as they relate to health care decision making.

Fun. Tease 'Some Nights' Video Ahead Of MTV Premiere

Band will perform at MTV Movie Awards on Sunday, along with Wiz Khalifa and Black Keys.

Two months ago, Fun. promised that their upcoming video for "Some Nights" would be "amazing," then followed up that claim by teasing that the clip featured (and also xylophones).

And now, after all that talk, we are finally getting our first glimpse at the video (which premieres Monday, June 4, at 3:55 p.m. on MTV) — thanks to a teaser clip posted by the band's label, Fueled by Ramen — and it looks like Fun.'s claims were warranted.

In the 30-second clip, we see Fun. performing amidst a Civil War battlefield, as flares erupt in the distance and Union and Confederate soldiers take aim at one another (said xylophone does not make an appearance). Directed by Anthony Mandler — who's made a career out of helming eye-catching clips for the likes of Rihanna, Jay-Z, Drake and the Killers — the "Some Nights" video appears to be a worthy successor to the band's breakout "We Are Young" clip, which still stands as one of 2012's best.

Of course, that assessment is based solely on a single sneak peek — you can catch the full "Some Nights" video when it premieres Monday, June 4, at 3:55 p.m. on MTV. And, of course, it comes on the heels of Fun.'s performance at the 2012 MTV Movie Awards, which air live on Sunday, June 3, at 9 p.m. ET/PT from the Gibson Amphitheatre in Universal City, California.

Fun. will share the stage at the big show with previously announced performer Wiz Khalifa and new additions the Black Keys and DJ Martin Solveig.

Head over to MovieAwards.MTV.com to vote for your favorite flicks now! The 21st annual MTV Movie Awards air live this Sunday, June 3, at 9 p.m. ET.

Taster's Choice: Why I Hate Raw Tomatoes and You Don't

I have a confession: I hate raw tomatoes. Really hate them. Really, really hate them. It?s a positively visceral reaction, beyond my conscious control. Even the smell makes me slightly nauseous. Once, as a kid, my mom got fed up with watching me shove tomatoes to the side of my plate, and insisted I couldn?t leave the dinner table until I ate them. I put it off as long as possible, but finally, desperate to get away and lose myself in the book du jour, I shoved the offending food into my mouth? and promptly gagged and spit it up. My mother, to her credit, threw up her hands in resignation. Her daughter would never eat raw tomatoes.

This intense hatred of raw tomatoes was incomprehensible to my mother; she loves them as much as I despise them. I suppose it?s equally incomprehensible to all the rest of your tomato-lovers out there. Frankly, it?s even a little incomprehensible to me, seeing as how I love ketchup and spaghetti sauce, provided there are no huge chunks of tomatoes ? boil and puree those suckers, and season with tons of garlic, olive oil, basil, thyme, and oregano, and it overcomes even my rebellious palate. All my life, I?ve been vaguely ashamed of my dislike, probably because it was such a profound disappointment to my mother, and naturally I craved her approval.

This would totally make me gag....

But no more! I just discovered that I am not alone in the blogosphere when it comes to hating raw tomatoes. Kylee Baumie of Living Green just came out of the closet as a ?mater hater.? So did Steve Bender, a.k.a., the Grumpy Gardener, and Chris Tidrick, who blogs at From the Soil. They recently discovered their mutual dislike while at a Garden2Blog event in Arkansas. Like Chris, I, too, carefully remove all bits of tomato from food and leave it on the side of the plate. Solidarity!

We mater-haters have to stick together. As Grumpy notes, ?Telling people you hate fresh tomatoes is like saying you hate giggling babies or that you loathe the prospect of world peace.?

I?ve wondered about this strange aversion for years. Why raw tomatoes? It might have something to do with the chemistry, and how it changes when tomatoes are cooked.

Oh, yes, cooking can change a foodstuff?s chemistry. For instance, there is an antioxidant called lycopene, found not just in tomatoes, but also watermelon, pink guava, red bell peppers, and papaya. In tomatoes, it seems to be affected by heat. I found a 2002 study in the Journal of Agriculture and Food Chemistry that determined levels of cis-lycopene rise 35% after tomatoes are cooked for 30 minutes at 190.4 Fahrenheit.

Rui Hai Liu, a food scientist at Cornell and the author of the study, thinks it?s because the heat breaks down the thick cells walls, and this makes it easier for the human body to absorb the nutrients bound up in those walls ? including lycopene. This seems to be confirmed by a 2008 study in the British Journal of Nutrition, which found that 198 test subjects who followed a raw food diet had low levels of lycopene, compared to other nutrients (Vitamin A, beta-carotene).

The same journal published a 2007 study by Steven Schwartz, who analyzed the structure of lycopene molecules and concluded that while the basic chemical properties of the molecule are the same whether cooked, processed, or raw, the form of lycopene that shows up in the human body has a bent molecular form, while the form in your standard raw tomato is more linear ? limiting how much can be absorbed into the bloodstream.

Schwartz developed a technique that subjects tomatoes to intense heat, and then combines them with fat (like olive oil), that changes the form from linear to bent. And that makes it more likely to be absorbed into the bloodstream. A small test study (12 subjects) did, indeed, find higher levels of lycopene in the bloodstream after consuming tomato sauces made via this process. Traditional home cooking techniques ? long, slow simmering times, reheating sauces day after day ? can have a similar effect. So cooking tomatoes does seem to change them in a chemically significant way.

Perhaps lycopene isn?t the culprit, however. I like watermelon, pink guava, red bell peppers and papaya, after all. Maybe it?s something to do with the smell, or one of the myriad other flavor compounds that?s at fault. People like me just lack certain key taste receptors, preventing us from appreciating the rich, sweet, meaty flavor of raw tomatoes that the rest of you are always rhapsodizing about. The problem is that tomatoes have something on the order of 400 volatile compounds and who knows which one of those (or combination thereof) might be responsible for the harsh reaction many of us experience in response to raw tomatoes?

Per a recent Wired article, Harry Klee, a plant molecular biologist, has managed to narrow things down a bit, identifying around two dozen compounds that seem to be involved in the tasty appeal (for people who are not me) of tomatoes. And it?s not the most likely suspects: a class called C6 volatiles. Instead, three compounds in particular ? geranial, 2-methylbutanal, and 3-methyl-1-butanol ? contribute to the sweetness of tomatoes, at least. Or maybe it has something to do with furaneol, another compound found in tomatoes that contributes to sweetness.

Frankly, the scientific community has been sadly remiss in getting to the bottom of the mystery of why raw tomatoes make some of us gag, despite a few scattered flavor studies. But they?re hot on the case of cilantro, an even more polarizing herb. I love cilantro. To me, it tastes fresh and citrusy with just a tinge of an herbal edge to it. But to some people, it just tastes like soap. Or worse. They have as strong a visceral reaction to cilantro as I have to fresh raw tomatoes.

Celebrity chef Ina Garten (a.k.a. the Barefoot Contessa) admits to disliking cilantro, and Julia Child memorably confessed in a 2002 Larry King interview that if she spotted cilantro in her food, she would pick it out and ?throw it on the floor.? There are Facebook groups devoted to the haters. Sometimes people post haiku about how much they hate cilantro. (?The curry sickens/ It looked good on the menu/ Alas, cilantro.?)

... but this? Mmmmm! Pile some more on my plate!

At least cilantro haters can point to a smidgen of scientific evidence that there is a genetic component to their dislike. A couple of years ago, behavioral neuroscientist Charles J. Wysocki (who works at the Monell Chemical Senses Center in Philadelphia) attended a twins festival in Ohio. He asked 41 pairs of identical twins and 12 pairs of fraternal twins to rate their reactions to the taste of cilantro, on a scale of plus 11 (yummy!) to minus 11 (gross!), with 0 indicating a neutral response.

More than 80% of the identical twins (who share 100% of their DNA) rated the taste of cilantro on a par with their siblings, compared to just 42% of the fraternal twins. A new study in the journal Flavour breaks this down into ethnic groups, finding that 21% of those with East Asian roots hate cilantro, compared to just 3% of those with Middle Eastern roots.

Wysocki thinks those who hate cilantro are reacting to its odor more than its flavor, and that the haters can?t detect certain pleasing chemicals in the leaf ? instead, they just detect that soapy aspect. From a chemical compound perspective, cilantro is less complex than raw tomatoes.

According to food chemistry expert Harold McGee, there are around six substances that contribute to the telltale aroma of cilantro, mostly fat molecules known as aldehydes. And yes, similar aldehydes can also be found in soaps and lotions ? and bugs, which make use of aldehyde-drenched body fluids as either an attractant or a repellant.? In contrast, Wysocki says that the fresh, flavorful, pleasantly herbal compound derives from dodecenal.

Wysocki conducted an experiment involving gas chromatography, a device that uses heat to separate the various molecules in something like cilantro, so subjects can take a whiff of each separate compound. People who like cilantro first detected the soapy scent, followed by the stronger citrus-y herbal scent we savor; but cilantro haters couldn?t smell the latter. At all.

?The person who hates cilantro is, in fact, detecting the soapy odor. But what they seem to be missing is the nice, aromatic green component,? Wysocki told MSNBC in 2011. ?It?s possible that they have a mutated or even an absent receptor gene for the receptor protein that would interact with the very pleasant smelling compound.?

Broccoli and Brussels sprouts also have Facebook groups for the haters. And here there is even stronger evidence of a genetic link ? in this case, the ability (or lack thereof) to taste bitterness, or certain bitter chemical compounds. I share the ability to taste bitterness with roughly two-thirds of the population.

In 1931, a chemist named Arthur L. Fox accidentally released the powdered form of phenylthiocarbamide (PTC) in his lab. He didn?t notice anything unusual, but his lab mate sensed a bitter taste. Subsequent experiments confirmed that this variation existed in the broader population, and that not being able to taste bitterness was a recessive genetic trait.

Perhaps, as Faye Flam mused last year, it is a side effect of some other gene or genes that adapted so we?d be sensitive to the acrid bitter taste of dangerous toxins, although this is still in the realm of speculation. One could argue that those without the bitter taste ability should have died off long ago as they blissfully munched on toxic plants ? mass extinction through poison. Yet people still inherit that recessive trait.

Blech! You can keep your Brussels sprouts too.

Those who can sense bitterness are probably responding to compounds called glucosinolates, present in most cruciferous vegetables, like broccoli, Brussels sprouts, and cauliflower. I happen to dislike all three, although not on the same visceral gag-worthy level as raw tomatoes. (I can, and have, eaten all in a pinch.) But on this front, at least, I can claim that part of that aversion lies in my genes.

About 25% of the population can?t taste propylthiouracil (PROP), a chemical that is similar to the bitter compounds found in cabbage, raw broccoli, coffee, tonic water, and dark beers. They are, in essence, ?taste blind.? I do not fall into that 25%; I?m sensitive to this particular bitter taste, thanks to a gene called TAS2R38 that encodes taste receptors on the tongue.

I have the (GG) variant; that and the (CG) version both result in being able to taste bitterness, since (C) is the dominant allele. The (CC) allele is the taste-blind version, although even then, there is a 20% chance that one still might be able to sense some bitterness, depending on what other genes they inherit.

There are 25 ?bitterness? genes known thus far; different bitter foods act through different receptors, and people can be high or low responders for one but not another. This is probably why I don?t mind grapefruit or tonic water, but balk at cruciferous vegetables.

Of course, genes are only half the story when it comes to, well, just about any trait, including taste preferences. No one gene could ever be responsible for whether we love or hate specific foods. There are so many different compounds related to flavor and aroma, not to mention texture (mouth feel), all of which contribute to how much we savor or loathe a food.

Furthermore, those tastes are subject to change. There are lots of foods I disliked as a child that I?ve come to tolerate, even savor. Raw tomatoes, though, still make me gag; that preference has withstood the test of time. Consider this a plea for everyone to be less quick to pass judgment on those who like things we loathe, or loathe things we love. It?s not like you?re going to shame anyone out of their dislike. Some of us just can?t help it.

NC Considers Making Sea Level Rise Illegal

According to North Carolina law, I am a billionaire. I have a full-time nanny for my children, I have won the Pulitzer Prize, and I get to spend the entire year taking guitar lessons from Mark Knopfler. Oh, my avatar? I haven?t got around to changing it, but by law, I now look like George Clooney. There?s also a supermodel clause, but discussing the details would be boasting.

You think I?m kidding, but listen to me: I?m from North Carolina, and that?s how we roll. We take what we want to be reality, and we just make it law. So I?m having my state senator introduce legislation writing into law all the stuff I mentioned above. This is North Carolina, state motto: ?Because that?s how I WANT it to be.?

You know, of course, about our passing May 8 of Amendment One, which has now written into our constitution anti-marriage discrimination against anyone who doesn?t fit one group?s image of marriage. It?s just as ugly as it sounds ? just as ugly as the last time we wrote such marriage discrimination into our constitution, in 1875, when instead of protecting us against the idea of same-sex couples marrying, it was protecting us against racial miscegenation ? down to the third generation, mind you. Good times!

Okay, though. These are hard days, people are crazyish, and you just have to soldier on, right? But then it turns out that North Carolina legislators are now tossing around bills that not only protect themselves from concepts that make them uncomfortable, they?re DETERMINING HOW WE MEASURE REALITY.

In a story first discussed by the NC Coastal Federation and given more play May 29 by the News & Observer of Raleigh and its sister paper the Charlotte Observer, a group of legislators from 20 coastal NC counties whose economies will be most affected by rising seas have legislated the words ?Nuh-unh!? into the NC Constitution.

Okay, cheap shot alert. Actually all they did was say science is crazy. There is virtually universal agreement among scientists that the sea will probably rise a good meter or more before the end of the century, wreaking havoc in low-lying coastal counties. So the members of the developers? ?lobbying group NC-20 say the sea will rise only 8 inches, because ? because ? well, SHUT UP, that?s because why.

That is, the meter or so of sea level rise predicted for the NC Coastal Resources Commission by a state-appointed board of scientists is extremely inconvenient for counties along the coast. So the NC-20 types have decided that we can escape sea level rise ? in North Carolina, anyhow ? by making it against the law. Or making MEASURING it against the law, anyhow.

Here?s a link to the circulated Replacement House Bill 819. The key language is in section 2, paragraph e, talking about rates of sea level rise: ?These rates shall only be determined using historical data, and these data shall be limited to the time period following the year 1900. Rates of seas-level rise may be extrapolated linearly. ?? It goes on, but there?s the core: North Carolina legislators have decided that the way to make exponential increases in sea level rise ? caused by those inconvenient feedback loops we keep hearing about from scientists ? go away is to make it against the law to extrapolate exponential; we can only extrapolate along a line predicted by previous sea level rises.

Which, yes, is exactly like saying, do not predict tomorrow?s weather based on radar images of a hurricane swirling offshore, moving west towards us with 60-mph winds and ten inches of rain. Predict the weather based on the last two weeks of fair weather with gentle breezes towards the east. Don?t use radar and barometers; use the Farmer?s Almanac and what grandpa remembers.

Things like marriage rules involve changing social mores and those who feel that certain types of marriage are wrong can be understood and even forgiven. They?re certainly on the wrong side of history, but it?s a social issue where emotion understandably holds sway over things like evidence.

But while the rising sea may engender emotion, it exists in a world of fact, of measurable evidence and predictable results, where scientists using their best methods have agreed on a reasonable ? and conservative ? estimate of a meter or more of rising seas in the coming century. In 2007 the Intergovernmental Panel on Climate Change gave a hesitant estimate of up to 59 centimeters of rise ?but even two years later that estimate already appeared low and scientists began to expect a rise of a meter or more.

No matter in North Carolina. We?ve got resorts to build and we don?t care what the rest of the ocean does ? our sea isn?t going to rise by more than 15.6 inches. Because otherwise it?s against the law.

No information on whether the scientists on the panel, like Galileo, have stamped their feet and muttered ?And yet it rises!? But there?s no doubt that NC?s legislative inquisitors will be classified along with Galileo?s papal persecutors and their own forebears who outlawed interracial marriage, as on the wrong side of history.

But these folks will also be wet.

I?d love to write more, but I have chores to do and kids to manage. Man ? all this housework after a full day of work at my desk just doesn?t seem right. There oughtta be a law. Hey, wait a minute ?.

Results from new climate adaptation survey

A majority of California's coastal planners and resource managers now view the threats from climate change as sufficiently likely that practical steps on the ground need to be taken to protect against growing threats, according to results from a new survey published by Stanford University's Center for Ocean Solutions (COS) and the California Sea Grant.

Survey respondents acknowledge the need to prepare for changes along the coast that might result from rising sea levels and other impacts, such as more floods, loss of beach access, coastal erosion and potential damage to transportation infrastructure, including highways, roads and ports.

The new survey an update on a similar one conducted six years ago shows a strong uptick in California coastal professionals' attention to preparing and planning for climate change. Results reveal that managers are ready and willing to develop adaptation strategies, despite tighter belts in most local and state agencies in recent years. But lack of money to prepare and implement plans, insufficient staff and lack of technical know-how are significant challenges.

"Communities are willing to adapt to the reality of climate change, but they are struggling. This is a story that needs to be told when billions of dollars in assets are at risk," said Susanne Moser, Director of Susanne Moser Research & Consulting in Santa Cruz and a Research Associate of COS. She worked with colleagues at University of Southern California Sea Grant, California Sea Grant and the University of California, Berkeley, and an unprecedented collaborative of 12 other coastal organizations in California to systematically probe coastal professionals' knowledge and attitudes toward global warming, their level of preparedness for the future, and the challenges they face in taking action.

The survey shows that 40 percent of coastal professionals who are responsible for protecting natural resources, property and human safety have begun trying to understand the risks they face, and another 40 percent are actively planning for climate change impacts, such as sea level rise, coastal flooding and erosion. Yet, only about 10 percent are actually doing things on the ground that may reduce the full brunt of climate change.

"The big take-away from the survey is that coastal managers are knowledgeable and understand the importance of preparing for climate change," said USC Sea Grant Associate Director Phyllis Grifman, a co-author of the survey report, Rising to the Challenge: Results of the 2011 California Coastal Adaptation Needs Assessment. "And they are doing what they can even before there is a mandate to develop adaptation plans. They know it is important, and they are concerned, both personally and at work, but they need help."

Most of the nearly 600 coastal professionals who responded to the survey describe a work environment that is already consumed by other pressing issues and constrained by limited fiscal and staff resources. More than 70 percent also indicate that they believe the severity of their leading management challenges, such as protecting water quality and wetland habitats, will further intensify in the next five years, creating yet higher hurdles in meeting the state's call to prepare and plan for rising sea levels.

The survey also allowed coastal managers to identify the information, training needs and tools that would make their work more effective. According to Juliette Finzi Hart, Regional Research and Planning Specialist at USC Sea Grant and lead author of the survey report, "The organizations that worked together on this survey have an opportunity and a responsibility to help California coastal managers meet the challenge of climate change. Information alone won't solve the problem, but we can help build coastal professionals' capacity to make our coasts a safer place to live and work."

Today at the Headwaters to Oceans (H2O) Conference in San Diego, Grifman will moderate a discussion of the survey results at a session on climate adaptation and coastal management. Panelists include Hart and co-authors Monique Myers of California Sea Grant, and Julia Ekstrom, a postdoctoral researcher at UC Berkeley.

In a second panel today, co-author Adina Abeles of COS will moderate a session of several survey partners addressing what California coastal managers need, in terms of information, training and tools, to deal with sea level rise and other climate change impacts, and how these organizations are helping to provide this technical assistance.

The current survey revealed a strong increase in adaptation activity compared to the very low level observed at the time of the first coastal adaptation survey conducted in 2005/2006. That survey conducted by researchers at the National Center for Atmospheric Research, including Moser found that among the local governments in coastal areas that were surveyed, only two counties at that time had begun considering climate change in their planning efforts, and another six cities and four counties were in the process. Five years later a marked shift is evident: today 93 percent of all survey respondents (including representatives from local, regional, state and federal entities) say they are in the process of understanding their climate change risks, assessing their adaptation options, or implementing a strategy.

"The survey results are timed perfectly with ongoing state efforts to update the 2012 California Climate Adaptation Strategy," said Abe Doherty, a project specialist at the Ocean Protection Council, one of the 15 organizations that collaborated on the survey. Others include the California Coastal Commission, NOAA Coastal Services Center and Southern California Coastal Ocean Observing System.

"It is important to get feedback on what coastal managers are using for information and what they need for technical assistance and training," said Doherty, who is currently drafting the ocean and coastal resources portion of the climate adaptation strategy. "The barriers are mostly fiscal for communities. We know we have limited funds, so what is the best approach for moving forward? We have to craft strategies and focus staff time strategically. The survey results help us prioritize staff time and resources."

Syrian ally Russia condemns massacre of 108 people in unusually harsh statement

BEIRUT - A weekend massacre of more than 100 people emerged as a potential turning point in the Syrian crisis Monday, galvanizing even staunch ally Russia to take an unusually hard line against President Bashar Assad's regime.

Analysts say Russia may be warning Syrian President Bashar Assad that he needs to change course or lose Moscow's support, which has been a key layer of protection for the regime in Damascus over the course of the uprising, which began in March 2011.

Russia has grown increasingly critical of the Syrian regime in recent months, but Foreign Minister Sergey Lavrov's latest comments were unusually strong. Although he said opposition forces have terrorists among them, he put the blame for 15 months of carnage primarily on Assad's government.

"The government bears the main responsibility for what is going on," Lavrov said in Moscow following a meeting with British Foreign Secretary William Hague. "Any government in any country bears responsibility for the security of its citizens."

Alexei Malashenko, a Middle East expert with the Carnegie Moscow Center, said Lavrov's comments suggest Russia may be backing away from its long-standing support for Damascus.

"Bashar Assad is driving himself and Russia into a corner," Malashenko said. "Bashar has definitely gotten the sense that he may lose Russia's sympathy and he may step back a bit."

It is not clear whether Assad's forces were exclusively to blame for the slaughter of 108 people Friday in Houla, a collection of poor farming villages in Homs province. The U.N. said 49 children and 34 women were among the dead; some had bullet holes through their heads.

The U.N. Security Council blamed Syrian forces for artillery and tank shelling of residential areas, but it did not clearly state who was responsible for the close-range shooting deaths and "severe physical abuse" of civilians.

Activists from the area say the army pounded the villages with artillery and clashed with local rebels. They said pro-regime gunmen later stormed the area, doing the bulk of the killing by gunning down men in the streets and stabbing women and children in their homes.

The Syrian government rejected that narrative entirely, saying soldiers were attacked in their bases and fought back in self-defence, but did not leave their bases.

Russia blamed both the regime and the rebels for the Houla massacre.

"Both sides have obviously had a hand in the deaths of innocent people, including several dozen women and children," Lavrov said. "This area is controlled by the rebels, but it is also surrounded by the government troops."

He said Russia has no interest in propping up Assad's regime, but wants Syria to guide its own transition under a plan brokered by special envoy Kofi Annan.

"We don't support the Syrian government, we support Kofi Annan's plan," Lavrov said.

Moscow's pro-Syria stance has been motivated in part by its strategic and defence ties, including weapons sales, with Damascus. Russia also rejects what it sees as a world order dominated by the U.S.

But as the country spirals toward chaos, Russia could scale back that support.

Losing Russian support could be disastrous for Assad because his crackdown has left him almost completely isolated internationally. Russia and China have stood by him so far, using their veto power in the past to block U.N. resolutions against him.

Hilal Khashan, a political science professor at the American University of Beirut, said the Houla massacre appears to be ushering in a change in Russia's position.

"There is a shift and the momentum against the regime is gathering," Khashan said. "The momentum is building and the Russians are not blocking the rising momentum."

The Syrian conflict is among the most explosive of the Arab Spring, in part because of Syria's allegiances to powerful forces including Lebanon's Hezbollah and Shiite powerhouse Iran.

Activists say as many as 12,000 people have been killed since the uprising began in March 2011. The U.N. put the toll as of March, a year into the uprising, at 9,000 but the count is out of date as many hundreds more have died since.

It is virtually impossible to independently verify the death toll in Syria.

Annan's peace plan, which calls for a cease-fire and dialogue, has been faltering for weeks, but many analysts see it as a way to unify the international community behind a single proposal.

Western leaders have pinned their hopes on Annan's diplomatic pressure, with the U.S. and others unwilling to get deeply involved in another Arab nation in turmoil.

Annan arrived in Damascus Monday for talks with Assad and other officials and called on "every individual with a gun" in Syria to lay down arms, saying he was horrified by the Houla massacre.

"This message of peace is not only for the government, but for everyone with a gun."

Britain's Prime Minister David Cameron and French President Francois Holland spoke on the phone and expressed their desire to work with Russia to resolve the crisis in Syria. A spokeswoman for Downing Street said Cameron and Hollande agreed to act together to "bring an end to the bloody suppression of the Syrian people."

Syria has brushed off nearly all international pressure since the uprising against Assad's regime erupted. Activists reported fresh violence Monday, saying troops shelled several neighbourhoods in Hama, killing at least 24 people.

Assad denies that he is fighting a popular uprising, saying terrorists and armed gangs are driving the unrest. His supporters point to a string of suicide attacks to support their claims that foreign terrorists ? not reform-seekers ? are behind the violence.

There are widespread fears that al-Qaida and other extremists may be joining the fray in Syria and exploiting the chaos there, but the opposition and the rebel force in Syria say they have nothing to do with any terrorist attacks.

Syria's uprising began with mostly peaceful calls for change in one of the most repressive regimes in the Middle East. But as the government cracked down on opponents with increasingly deadly force, many protesters began taking up arms.

The conflict has grown dangerously militarized. Rebel fighters say they are targeting soldiers and military installations to chip away at the regime's power and protect civilians. Now the international community has nearly run out of options for halting the slide toward civil war.

Attack on candidate's HQ as vote polarizes Egypt

CAIRO (Reuters) - An arson attack on the headquarters of one of the two candidates in Egypt's presidential election has marred campaigning for the second round in a vote that has polarized the nation with the choice of an Islamist or Hosni Mubarak's last prime minister.

Protesters set fire to storage rooms and smashed computers late on Monday at the campaign headquarters of Ahmed Shafiq, a 70-year-old former air force chief and Mubarak official, who was confirmed as a run-off candidate after the first round vote.

His rival is Mohamed Mursi, a senior member of the Muslim Brotherhood, Egypt's main Islamist group which controls the biggest bloc in parliament after an earlier election. The deciding presidential vote is on June 16 and 17.

Mursi, 60, drew support from a disciplined group of backers of the Brotherhood, banned under Mubarak, and Shafiq attracted Egyptians who want a strongman to restore law, order and prosperity after 15 months of turmoil since Mubarak's ouster.

Neither won more than a quarter of votes cast in the first round, leaving an agonizing choice for a sizeable portion of the electorate who backed more centrist candidates and do not want a conservative Islamist or an ex-military officer at the helm.

Thousands of Egyptians took to the streets on Monday night in protest after the results of the first round were confirmed by the election committee. Some held up posters of Mursi with a cross over his face. But most were chanting against Shafiq.

Dozens then marched from the protests around Tahrir Square, where hundreds of thousands played out a drama that toppled Mubarak, to Shafiq's headquarters in the upscale Cairo district of Dokki.

"They seemed to know what they were after and they went directly to the storage rooms and set them on fire using petrol bombs," said Ahmed Abdel Ghani, 30, a member of Shafiq's campaign, surveying a scene of unusable, charred campaign flyers and leaflets scattered on the ground.

The main villa escaped the flames but protesters smashed laptops and computers inside, he said. Daubed on the wall outside the villa were the words: "No to Shafiq, no to feloul," an Arabic word referring to "remnants" of Mubarak's era.

Shafiq has made no secret of his admiration for Mubarak, describing him as a role model after his own father. Protesters threw stones and shoes at him when he voted in Cairo last week.

"We condemn the attack but we still don't know who is behind it and will wait for investigations. But we are continuing our work and path and hopefully all will end well," said one official in the campaign, who asked not to be named.

BLOODY TRANSITION

The flare-up was the latest in an already messy and often bloody transition to democracy since generals took over from Mubarak after a popular uprising forced him out on February 11, 2011. The army has pledged to hand over power by July 1.

Even before the first-round vote, revolutionaries who led the demonstrations that brought down Mubarak had promised to hit the streets if Shafiq progressed in the vote to become president of the Arab world's most populous nation.

Yet any violence could help Shafiq's cause as his strongest card in the race is his promise swiftly to restore law and order, which collapsed after Mubarak's downfall.

Many Egyptians were happy to see the back of Mubarak, yet are now desperate for stability to revive the shattered economy. Shafiq is seen as having the army backing to achieve that.

Both Shafiq and the Brotherhood are now trying to rally support from more centrist voters in the second round. But youth leaders of the uprising fear they would be surrendering their revolution by voting for Mursi or Shafiq and liberals are also deeply uncomfortable with the available candidates.

Liberal and other political groups have often criticized the Brotherhood for being slow to join the anti-Mubarak revolt, acquiescing too quickly to the ruling generals and seeking to dominate the political scene after their parliamentary success.

Mursi's supporters believe Mursi and the Brotherhood, which has a social network with grass-roots support across Egypt, are the best hope for reforming a corrupt state.

"Protests are expected. Not everyone will be satisfied with the result, some will object to it but we hope that the people's choice will be with the revolution," said Fareed Ismail, a senior figure in the Brotherhood's Freedom and Justice Party.

"The situation in Egypt is in a critical and dangerous phase. We must work together so that the revolution isn't lost," he told Reuters.

The Brotherhood denied any role in the attack on Shafiq's headquarters. Other candidates who lost in the first round also condemned the violence.

Hamdeen Sabahy, a leftist candidate who came third in the race and now being courted by the Brotherhood, said in a statement it was the "right of the people to express their opinion provided demonstrations were peaceful".

A Brotherhood source, who asked not to be named, said the Islamist group had prepared a menu of options to tempt rival groups and politicians to its side, including backers of first-round loser and ex-Brotherhood member Abdol Moneim Abol Fotouh.

Until now, fourth-placed Abol Fotouh has called for his supporters to "stand united against the symbols of corruption and oppression" - a reference to Shafiq - but has not explicitly said he would back Mursi.

Like Sabahy, fifth-placed former Arab League chief Amr Moussa, once a favorite, has not backed either candidate.

The ultra-orthodox Salafi Muslim Al-Nour party, which controls the second biggest bloc in parliament and had backed Abol Fotouh, has thrown its weight behind Mursi.

The Brotherhood source said the group has offered: creating a five-member advisory council to advise the president; assigning the posts of prime minister or vice-president to Abol Fotouh and Sabahy; distributing cabinet posts to other parties; and offering compromises on planned laws and on an assembly tasked with drafting a new constitution.

Four candidates complained about the vote conduct but the election committee dismissed all the complaints.

Former U.S. President Jimmy Carter said he was broadly confident about the election process although Carter Center monitors highlighted several irregularities, notably lack of access in the final aggregation of national results.
